The following Privacy and Security Policy lets you know what information we collect when you visit our website, Moda Seating.com, why we collect it, and how it is used. This Privacy and Security Policy also addresses our data security practices.

We may need to collect personal information from you for a specific purpose, such as to provide you with certain information you request. We may collect information actively generated by the purchase of a product or service, such as a payment method. We use this information to process your order.

How do we protect information we collect?

We offer secure web pages to collect certain kinds of user information and we store certain kinds of data in encrypted form. We maintain strict physical, electronic, and administrative safeguards to protect your personal information from unauthorized or inappropriate access. While no computer system is completely secure, we believe the measures implemented by our website reduce the likelihood of security problems.

We may share the personal information you provide with other companies we have hired to provide services for us. These companies – our vendors – are contractually bound to use personal information we share with them only to perform the services we have hired them to provide. We do not share, sell, or lease personal information about you to any third-parties for their marketing use. We will release information about you if you direct us to do so, if we are required by law to do so, or in other legally limited circumstances (for example, to protect your account from fraud).

By using the Moda Seating website, you agree to this Privacy and Security Policy. This is our entire and exclusive Privacy and Security Policy and it replaces any earlier version.

Terms On Conducting Business:

You agree to the terms and conditions that are listed below, and the specified terms mentioned in the individual product descriptions. These are simply “playing by the rules” of good business.

Payment Terms:

Customers are required to pay in full before the order is processed. On customer orders a 50% deposit is required before the order is processed and the balance must be remitted before shipping the order. Bad checks will be prosecuted if the customer does not immediately make good on them.

Payment Method:

We accept wire transfers, checks, and all major credit cards.

Checks must clear before the order is processed. It takes 7-10 business days before a check clears. Any lead time that was provided does not include the additional 7-10 business days needed for a check to clear.

All customers should review their estimates, and provide a signed confirmation that what is stated on their quote is what they are ordering. Our company works diligently to become knowledgeable of our various products. We “listen” to customers business needs, and try to meet them; however, we are not “mind readers”, and whatever verbal conversations that have taken place over time cannot be considered a commitment on our part unless it is on the estimate. We all make errors; the signed estimate is your final business decision. What is on the estimate is what your business has ordered. Review the SKU, product description, quantity, specifications (product finish, upholstery), etc. Any errors found after the quote has been finalized, or errors discovered upon delivery, is not the responsibility of Moda Seating.

Shipping:

Moda Seating tries to provide you with a great product at the lowest possible cost to you. Our shipping fees are at lowest rates possible, ensuring fast and affordable service to you.

Products ship via freight carriers throughout the U.S. and Canada. The Manufacturing – shipping process varies as stated on each individual item. Expedited shipping options are available at times upon request. Transit time depends on the location and product you chose. In case your order is needed at an earlier date, contact us and we will try to hasten things for you. We will inform you of any additional charges, if applicable. Please notify us of any special delivery instructions.

Ship dates, delivery dates, and carrier information are subject to to change.

Delivery dates are not guaranteed. If a delivery is disputed, the customer will be responsible for any charges that apply.

All shipping dates on invoices are estimated times and orders should be expected at earlier or later dates. Tracking information will be forwarded to you after your order ships. You will not be notified prior to delivery and should expect your order at allotted times.

Orders ship from DOCK TO DOCK via freight carriers. Freight drivers do not help you unload. They do not operate like UPS Ground that place the package inside the front door. Drivers do not help or assist, unless the customer pays extra for lift gate services; normally an additional $100-$200.00 (depending on freight carrier). If a customer needs Inside Delivery, that is an additional $200-$500.

All shipments follow standard commercial delivery protocol:

a) The customer has loading dock

b) The customer is responsible for unloading products

c) Access to the unloading area is not limited

d) The business is within commercial zoning

All deliveries that do not meet the above commercial delivery criteria, including, but not limited to:

a) Limited access delivery

b) Residential or Non Commercial delivery

c) Lift-Gate services

d) Inside Delivery

e) Limited delivery times (i.e.: only between certain hours)

f) Weekend delivery

g) Call before delivery notification

h) Driver's labor associated with off loading (Note: Driver is under no obligation to assist with off loading unless specific previous arrangements are made.)

i) Re-delivery

j) Storage

k) Re-consignment

will be subject to additional chargers.

You will be automatically charged for any add-on additional requests made upon the receipt of your order. Such as a lift gate or inside delivery.

A redelivery charge is applied if the carrier attempted delivery between the hours of 8:00 am – 6:00 pm without customer present.

It is the customer's responsibility to inspect the merchandise at the time of delivery. Do not sign the bill of lading before you are sure the items arrived in good condition. In the event that you find the products damaged or defective, make all notations on the bill of lading and take necessary photos before driver leaves. Our company must be notified of damaged goods within 48 hours in order for us to pursue a claim on your behalf. RETAIN ORIGINAL PACKAGING and a call tag will be issued to you. Merchandise will be picked up, or an exchange issued. Once the delivery receipt is signed as "Shipment Received in Good Order" or without any note of damages, no claim will be valid or honored. If driver was not willing to wait, you must mark the receipt saying "Driver not willing to wait. Possible damage." Do not return any item to the manufacturer without prior written authorization; otherwise it will not be processed.

Please follow the above instructions carefully when receiving your goods.

If the shipping address is changed at time of delivery additional charges should be expected, that is even if the new address is in close proximity to the original shipping address.

Call Before Delivery: All orders requesting a call before delivery are subject to a $75.00 charge.

Availability of Stock: Moda Seating does not guarantee availability of items shown on the website. Certain products may be discontinued at manufacturer's discretion without notice.

Return Policy / Warranty

Moda Seating.com products are manufactured to the customer's specifications and as such are considered custom orders. Therefore all sales are final. No returns or refunds will be accepted.

Moda Seating acts as a distributor between the manufacturer and customer. Each item has a unique warranty that is created by its own manufacturer and will be subject to its designated warranty policy in regards to damages, defects, replacements, or returns. Moda Seating will not be held responsible for any warranty policies set by involved manufacturers.

The manufacturer's warranty differs for each item. A copy of the manufacturer's warranty information is available upon request prior to placing the order. A request of the manufacturer's warranty after the order has been placed cannot be fulfilled.

Most warranty policies concerning damaged furniture will allow for joints that came apart, and only without signs of forced abuse like chipped or broken wood.

Moda Seating reserves the right to inspect all merchandise related to a claim on the deficiency of a product. Upon investigation, it will be determined if the claim will be honored. The customer will be responsible to ship the products to our facilities for the claim to be reviewed.

The Manufacturer's Warranty applies only to products purchased at list price.

Any Claim regarding a product will be forwarded to the manufacturer. It is not guaranteed that the claim will be honored.

If a return or cancellation is authorized, there will be a 30% restocking fee on in-stock items only. The customer will not be refunded for the shipping costs involved in the initial order. In addition, the customer will be responsible for the cost of returning the products. If a replacement was authorized, then the customer will be liable to pay for the cost of shipping as well.

In the event Moda Seating is responsible for a return and its charges, Moda Seating will arrange for pickup.

Samples:

We understand that fabrics and colors you see on your computer screen might look different in real life; we therefore offer you samples for better evaluation. Please contact us at if you require wood chip or fabric samples. These will be sent using UPS ground service and should be received within several business days.

General Policy:

State/City Requirements: We take no responsibility for any state requirements or standards. Any specification or requirements that need to be met should be mentioned when placing the order. Our products are not manufactured to meet any state requirements such as fire ratings, etc.

Minimum Order: All orders must exceed $1000.00, not including tax or freight. All orders that do not exceed this amount are subject to a $130.00 Small Order Charge Fee.

When you place your order you are accepting the limitations inherent in not directly viewing samples.
